The Supreme Court declined on Monday to take on a Pennsylvania school district’s suit defending the suspension of two middle school girls for wearing risque charity wristbands promoting breast cancer awareness, the Associated Press writes.
The decision leaves in place lower-court rulings in favor of the students, who sued the Easton Area School District after being disciplined in 2010 for defying a prohibition on bracelets bearing the slogan “I (heart) Boobies.”
Easton was one of several districts nationwide to ban the wristbands distributed by the Carlsbad, Calif.-based Keep a Breast Foundation, arguing that they are lewd and could provoke classroom disruptions. Courts have sided with the students’ contention that their punishment for wearing the items violated their free-speech rights.
