The American Civil Liberties Union of Oregon has filed suit on behalf of a Portland family to prevent the Portland School District from allowing the Boy Scouts to recruit in public schools.
The lawsuit, filed in Multnomah County Circuit Court, argues that recruiting Cub Scouts during school hours and on school property is unconstitutional because the Boy Scouts of America denies membership to boys who do not profess a belief in God.
Nancy Powell, whose son, Remington, is in the second grade, is an atheist who contends that the school violated the constitutional separation between church and state by allowing the Boy Scouts to recruit during school hours.
