House Committee Presses for Review of Health Clubs

The chairman of the House Committee on Small Business has asked the Treasury Department to file a long-awaited report on charities that offer health and fitness activities that may compete with those offered by businesses.
Rep. Don Manzullo, an Illinois Republican who became chairman of the Small Business Committee in January, reminded the Treasury Department that Congress had requested a report from the department more than two years ago that was never submitted.
In the fall of 1998, Congress directed the Treasury Department to report “on the statutory and regulatory changes that may be needed to assure that the health and fitness activities of these organizations substantially further the purposes for which the organization was granted tax exemption and do not constitute unfair competition with private sector, taxable organizations.”
In a letter to the Treasury Department, Mr. Manzullo said that the report would be useful as his committee continues to consider the general issue of unfair competition with business. Said Mr. Manzullo: “The House Committee on Small Business has a significant interest in the competitive conditions that allow our nation’s entrepreneurs to prosper.”
