N.Y. Court Tosses Suit Opposing Diller-Funded Park on Hudson

A lawsuit filed last year by a nonprofit critical of media mogul Barry Diller’s planned park and performance center on a Hudson River pier was dismissed Thursday by a New York State judge, The New York Times reports. The billionaire philanthropist pledged $113 million through a family foundation to cover most of the cost of building the 2.4-acre Pier 55, which would jut into the river in Lower Manhattan.

State Supreme Court Justice Joan Lobis rejected the City Club of New York’s contention that the project was approved without proper public scrutiny and should be held up pending a new environmental review and an OK from the state legislature. Michael Gruen, the civic organization’s president, said it is weighing an appeal.
