Request for Nonprofit Information Denied
October 3, 2002
The U.S. District Court for the District of Columbia has denied a request by a publisher of tax documents and other information for copies of IRS rulings that deny or revoke a charity’s tax-exempt status.
Tax Analysts asked the IRS last year for copies of the rulings, which it said are of interest to the public. The IRS denied the request, saying the rulings are confidential tax-return information, and Judge Ricardo M. Urbina upheld the IRS’s position. Tax Analysts said it may appeal the decision (Tax Analysts v. Internal Revenue Service, No. 00-2914).
