Supreme Court Turns Down Telemarketing Case

May 22, 2006 | Read Time: 1 minute

The U.S. Supreme Court last week decided not to review a case in which two charities charged that the Federal Trade Commission had infringed on their free-speech rights, reports the Associated Press.

The National Federation of the Blind and Special Olympics Maryland said that the commission had exceeded its authority by prohibiting calls that are followed by at least two seconds of silence before the caller speaks, and requiring callers to promptly state their business.

A lower court had ruled that the commission’s prohibitions were acceptable ways to protect the privacy of Americans.

The Supreme Court’s decision not to review the case means that the telemarketing rules will stay in place.
