A Template to Help Charities Develop Gift Agreements

This sample legal agreement for an endowment gift, provided by the Partnership for Philanthropic Planning, sets the terms for how a charity will use an irrevocable gift.

The agreement also specifies how the charity will treat the gift if, at some point in the future, the donor’s designation is no longer feasible.

This is not a one-size-fits-all document, but a guide to help gift planners as they create their own customized agreements. The agreement language should be reviewed by all parties to the gift, including the donor’s advisers and family members, says Barbara Yeager, the partnership’s director of operations.

The agreement should be signed by the donor and an officer of the charity.
